Terms of Service
These terms of service govern your use of the London Bus Pal mobile application and websites (buspal.app and londonbuspal.co.uk) operated by Mulder Digital Ltd (company number 11763023).
Your Statutory Rights
Nothing in these terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable legislation. Where these terms conflict with your statutory rights, your statutory rights will prevail.
Acceptance of Terms
By downloading, installing, or using London Bus Pal, you agree to be bound by these terms. If you do not agree to these terms, please do not use our app or services.
Description of Service
London Bus Pal provides real-time arrival information for London transport, including Tube, bus, Overground, Elizabeth line, DLR, tram, and National Rail. The app displays live arrival times, route information, and allows users to plan journeys and upload photos.
Data Sources and Accuracy
Important: Prediction data is supplied by Transport for London and National Rail Enquiries. The purpose of this app is to keep you updated on the latest arrival times based on traffic conditions and other factors. Expected times might change based on local conditions whilst you are waiting, as this is exactly the point of live transport tracking.
We cannot guarantee the accuracy of arrival times, route information, or journey planning suggestions. For static timetables, please refer to the information at stops and stations.
User Accounts and Eligibility
To use certain features of London Bus Pal, you may need to create an account. You must be at least 13 years old to create an account.
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
Subscription Services
Premium Features
London Bus Pal offers premium subscription plans that provide:
- Ad-free experience
- Increased photo upload limits
- Additional features as they become available
We may occasionally provide complimentary premium access for various reasons, which we reserve the right to modify or retract at any time.
Some users may have legacy lifetime ad-free access purchased before subscriptions were available. For any enquiries about subscription status or legacy access, please contact us at support@buspal.app.
Billing, Renewals, and Refunds
All subscription billing, renewals, cancellations, and refunds are handled entirely by the Apple App Store or Google Play Store as the merchant of record. Please refer to their respective terms and refund policies. We do not process payments or refunds directly.
Free Trial
New users who have never had a subscription may be eligible for a 7-day free trial, managed by Apple App Store or Google Play Store according to their respective terms.
User-Generated Content
Photo Uploads
When uploading photos to London Bus Pal, you grant Mulder Digital Ltd a worldwide, royalty-free, non-exclusive licence to use, display, reproduce, and modify your uploaded photos within the London Bus Pal application and for promotional purposes. You retain ownership of your photos and may request removal at any time by contacting support@buspal.app.
By uploading a photo, you confirm that:
- You have permission: You own the photo or have obtained the necessary permissions to upload it. DO NOT UPLOAD PHOTOS WHICH ARE NOT YOURS, as this may constitute a criminal offence.
- Public sharing: Your photo will be publicly shared and may be visible to other users of the app.
- Moderation: All photos are subject to moderation, and we reserve the right to reject, remove, or modify any uploaded content at our discretion.
Upload Limits
Free users may upload up to 5 photos, whilst premium subscribers may upload up to 10 photos. These limits are subject to change.
Vehicle Information Suggestions
Users may submit suggestions to update vehicle information. All submissions go through a moderation process and may or may not be accepted. Users who supply fake or false data may be banned from future submissions.
Prohibited Uses
You agree not to use London Bus Pal for any of the following:
- Uploading content you do not own or have permission to use
- Submitting false, misleading, or inaccurate information
- Harassing, threatening, or abusing other users
- Uploading inappropriate, offensive, or illegal content
- Attempting to interfere with or disrupt the app's functionality
- Reverse engineering, decompiling, or attempting to extract source code from the app
- Accessing, using, or attempting to use our backend APIs, data feeds, or services outside of the app
- Using the app for any commercial purpose without permission
- Violating any applicable laws or regulations
Intellectual Property
London Bus Pal and its content, features, and functionality are owned by Mulder Digital Ltd and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
Transport data is provided by Transport for London and remains their intellectual property.
Disclaimers and Limitation of Liability
Important: Liability We Cannot Exclude
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
Service Availability
Subject to the paragraph above, your use of London Bus Pal is at your sole risk. The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will function uninterrupted, secure, or be available at any particular time or location, or that any errors or defects will be corrected.
Transport Information
London Bus Pal provides information for convenience only. We are not responsible for:
- Missed buses due to incorrect timing information
- Route changes or service disruptions
- Journey planning suggestions that are not optimal
- Any decisions you make based on information provided by the app
Transport-related issues should be taken up with the relevant transport operator.
Limitation of Liability
Subject to the exclusions above that cannot be limited by law, in no event shall Mulder Digital Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Account Termination
We may terminate or suspend your account with reasonable notice for material breach of these Terms. You may delete your account at any time using the "Delete all my user data" option in the app settings.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.
Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal data.
Third-Party Services
London Bus Pal integrates with third-party services including:
- Apple App Store and Google Play Store for billing and subscriptions
- Transport for London for transport data
- Google services for maps, analytics, and advertising
- Other service providers as described in our Privacy Policy
Your use of these services is subject to their respective terms and conditions.
Changes to Terms
We may update these terms from time to time. We will notify you of significant changes by posting the updated terms in the app or on our website. Continued use of London Bus Pal after changes constitutes acceptance of the new terms.
General
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
- Entire agreement: These terms, together with our Privacy Policy, constitute the entire agreement between you and Mulder Digital Ltd regarding the Service.
- Waiver: Our failure to enforce any provision of these terms does not constitute a waiver of that provision.
- Assignment: We may assign or transfer these terms. You may not assign your rights or obligations without our written consent.
Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
